थाने आए आदमी को जंजीर से बांधने पर हाई कोर्ट सख्त, पुलिस से पूछा सिस्टम पर भरोसा कैसे होगा?

कोच्चि (केरल). केरल उच्च न्यायालय (Kerala High Court) ने मंगलवार को पुलिस (Police) से सवाल किया कि शिकायत दर्ज कराने थाने में आए एक आम आदमी को अगर जंजीरों से बांध दिया जाए और उसके खिलाफ पुलिस अधिकारी को काम करने से रोकने का मामला दर्ज कर लिया जाए तो ऐसे में उसे व्यवस्था में भरोसा कैसे रहेगा. न्यायमूर्ति देवन रामचन्द्रन ने कहा, ‘आम लोगों को व्यवस्था में विश्वास कैसे होगा? ऐसी स्थिति में लोग थाने कैसे आ सकेंगे?’ अदालत ने मामले की अगली सुनवाई के लिए 26 नवंबर की तारीख तय की है.
अदालत ने इस व्यक्ति की याचिका पर सुनवाई करते हुए पुलिस से ये सवाल किए. पेश मामले में व्यक्ति ने याचिका देकर दो पुलिसकर्मियों की प्रताड़ना से सुरक्षा की मांग की थी, जिनमें से एक पुलिसकर्मी ने उसकी शिकायत की रसीद मांगने पर उसे थाने में ही कथित रूप से जंजीर से बांध दिया था. याचिका के मुताबिक, पुलिस अधिकारी ने ना सिर्फ व्यक्ति को थाने में जंजीर से बांधा बल्कि उसके खिलाफ केरल पुलिस कानून की धारा 117 (ई) के तहत पुलिस अधिकारी को कर्तव्य निभाने से रोकने का मामला दर्ज किया.

शिकायतकर्ता के खिलाफ मामला दर्ज करने को ‘कानूनी प्रक्रिया का दुरुपयोग’ करार देते हुए अदालत ने सवाल किया कि पुलिस यह कैसे कह सकती है कि थाने में शिकायत दर्ज कराने आये व्यक्ति ने एक पुलिस अधिकारी को उसका काम करने से रोका. अदालत ने कहा, ‘क्या हम ऐसे देश में रह रहे हैं जहां कानून या संविधान का कोई शासन ही नहीं है.’ अदालत ने इस संबंध में पुलिस से कार्रवाई रिपोर्ट भी मांगी.
अदालत ने यह भी कहा कि इस घटना से संबंधित अधिकारी का शुरू में सिर्फ उसका तबादला किया गया लेकिन न्यायिक हस्तक्षेप के बाद ही उसे निलंबित किया गया. अदालत ने पूछा, ‘तबादला किसी प्रकार की सजा कैसे हो सकती है.’ अदालत ने यह भी जानना चाहा कि क्या इस घटना का कोई सीसीटीवी फुटेज है क्योंकि पुलिस थानों के सार्वजनिक स्थानों पर जहां लोग आते-जाते हैं वहां कैमरे लगाने हैं.
